質問です。 1) If I threaten to expose a criminal act or embarrassing private information unless I am paid money, I have committed blackmail.この文の前後で、それぞれの行為は違法ではなくとも、合わされば犯罪となる事もある、という事を話しているのですが、それを踏まえてこの文を考えると、恐らく「もし犯罪行為や恥ずかしい個人情報を暴露すると脅しをかけ、お金をもらうとこれは恐喝となる。」という意味のはずなのですが、(情報暴露をする事は発言の自由、お金をかせぐ行為も合法、だが合わさると違法)unlessの部分が矛盾している気がします。どこで理解を間違えたのでしょうか?また、似たような文にFor example, when a blackmailer threatens to turn in a criminal unless paid money.という文も後にでてきます。

2) Consequently, most blackmail statutes broadly prohibit behavior that no one really believes is criminal and rely on the good judgement of precursors not to enforce relevant statutes precisely as written.という文ですが、rely on の主語はblackmail statutesでいいのでしょうか。前半は理解できましたが後半、rely on good judgement…statutesとまたstatutesが出てきて混乱しました。

3) The blackmailer obtains what he wants by using a supplementary leverage, leverage that depends upon a third party.ここでleverageと繰り返されているのは何か意味があるのですか?会話ではよく聞きますが文法的にはthatの前のleverageはなくともいいと思うのですが。

4) Their assumption-true enough, it seems-was that a victim of blackmail would be harmed if shameful but private information were revealed to the world. ここのbutの用法なのですが、これは前置詞と考えていいのでしょうか。恥ずかしい、けれどもプライベートな情報?andと置き換えられる気がしたのですがandでは意味が変わってしまうのでしょうか。

5) The party who had or threatened to reveal shameful facts had to show positive cause for the privilege of revealing the information.のpositive cause for the privilege ofはどう理解したらいいでしょうか。「~の法的権利の明白な理由」でいいのでしょうか。

6) But even if it were true, the revelation of shameful information was protected only if the revelation had been made for a legitimate purpose and dealt with a matter that the public authorities had an interest in having revealed.これは暴露した事が守られるかどうかの話なのか、暴露された側が守られるかどうかの話なのかどちらなのでしょうか。最初はされる側だと思ったのですが、revelation of shameful informationはする側のような気もしてきました。
(これの前の文はIn short, assertion of the truth of the shameful fact being revealed was not, in itself, sufficient to constitute a legal privilege. Granted, truth was not wholly irrelevant; false disclosures were granted even less protection than true ones.です)

→ 金を払わないかぎり、犯罪行為や恥ずかしい個人的な情報を暴露すると私が脅せば、私は脅迫したことになる。
* unless ~ は、expose の条件になっています。


2) Consequently, most blackmail statutes broadly prohibit behavior that no one really believes is criminal and rely on the good judgement of precursors not to enforce relevant statutes precisely as written.
→ 従って、ほとんどの脅迫規制法は実際には誰もそれが犯罪だと思わない行為を禁ずる一方、当該法規を書かれている通りに厳密に施行しないという先達の良き判断に頼ってきた。
* rely on の主語はblackmail statutesでOKです。


3) The blackmailer obtains what he wants by using a supplementary leverage, leverage that depends upon a third party.
→ 脅迫者は自分の欲しいものを補助的なテコを使って得る。そのテコは第三者に依存しているテコである。
* that の前の leverage を取る場合には、that を which に変える必要があります。

→ 恥辱的な事実を所有したり、それを暴露すると脅したりする側は、その情報を暴露する特権に対して、positive cause (建設的な正当性) があることを示さなければならない。
* 私は法学については門外漢ですので、個々の訳語の妥当性は法学の専門家のあなたが考えてください。privilege of doing は、「doing する特権(=その人に特別に与えられた権利)という意味です。


6) But even if it were true, the revelation of shameful information was protected only if the revelation had been made for a legitimate purpose and dealt with a matter that the public authorities had an interest in having revealed.
→ たとえその情報が真実であったとしても、恥ずかしい情報を暴露することは、その暴露が正当な目的で行われ、その暴露が公的権威が暴露に利益を持つような事柄を扱っている場合にのみ、保護されている。
